The Bailiff Is Charging Interest On The Judgment Debt
Bailiffs may charge interest on a county court judgment or a High Court Writ unless the court has ordered interest to be payable by the judgment debtor on the judgment.
The court may award interest under section 69 of the County Courts Act 1984, which the terms must appear on the judgment. If the judgment debt remains unpaid within a certain period, the court may award interest on the debt, which the debtor would be responsible for paying in addition to the sum adjudged.
A creditor may recover interest on commercial debts governed by the Late Payment of Commercial Debts (Interest) Act 1998.
